Terms & Conditions for Booking a Service

These Terms and Conditions for Booking a Service (“Booking Terms”) apply to all bookings made through Connecting Jamaica’s platform.
They supplement and are incorporated into our General Terms & Conditions and Privacy Policy.
By making a booking, you agree to these Booking Terms.
1. Definitions & Interpretation
“Platform / Website / Site”: The online platform operated by Connecting Jamaica, including its mobile and web applications.
“User / You”: Any individual or business accessing or using the platform, including customers and service providers.
“Provider / Vendor / Supplier”: Third-party individuals or entities offering services via our platform (e.g. tours, transfers, accommodations).
“Booking / Service Agreement”: The binding contract between the User and Provider for the delivery of a listed service.
“User Content”: All information, feedback, media, or text submitted by Users through the platform.
2. Platform Role & Contract Formation
2.1 Marketplace Only
Connecting Jamaica acts as a marketplace facilitator.
We are not a travel agency and do not own, operate, or manage the services listed.
When you book a guided tour, workshop, airport transfer, or other service (each a “Product”) via our platform, Connecting Jamaica provides the marketplace and booking facilitation, but does not itself provide or control the actual service.
2.2 Contractual Relationship
When you book a Product, your agreement is with the Supplier, not with Connecting Jamaica.
Your booking is a contract between you (“Customer”) and the supplier/provider (“Supplier”) of that service.
Connecting Jamaica acts as a disclosed agent on behalf of the Supplier (i.e. we accept bookings on behalf of the Supplier) and in some cases a marketplace facilitator.
2.3 No Endorsement
We do not certify, approve, endorse, guarantee the quality, safety, legality, or existence of any Supplier or Product. Users must independently assess suitability and safety.
3. Using the Services & Account Registration
3.1 You must be 16 years or older (or age of majority in your location) to use our platform.
By registering, you confirm authority to bind yourself or your business.
3.2 You must provide truthful, accurate information and maintain it.
3.3 You are responsible for safeguarding your account credentials and must notify us of any unauthorized access.
4. Listings, Bookings & Transactions
4.1 The platform facilitates discovery and booking of services.
The Provider is solely responsible for service delivery.
4.2 You must carefully review the full listing (price, schedule, terms, inclusions/exclusions) before booking.
4.3 The booking price you pay will include all taxes, fees, and applicable charges unless otherwise stated. Some items (tips, visas, baggage, personal insurance, optional extras) may be excluded. Currency conversion may apply depending on your location or payment method.
4.4 Payment is processed via secure third party payment processors (e.g. Stripe, PayPal, etc.).
By placing a booking, you authorize us (or authorized processors) to charge your selected payment method.
4.5 Providers may request information (e.g. age, weight, arrival time).
You agree to supply this promptly if required.
4.6 If the Provider cancels or fails to deliver, you may request a refund or alternative, subject to the listing policy.
4.7 You may request changes (reschedules, attendee adjustments) via our platform.
Changes are subject to Provider approval and availability.
4.8 Disputes between Users and Providers must be submitted to our mediation process.
We may assist but are not liable for outcomes.
4.9 Once your booking is accepted by the Supplier, you will receive a booking confirmation via email. If you do not receive confirmation immediately, it may take up to one (1) hour.
5.0 If the requested Product or option is unavailable, we will notify you promptly.
You may choose an alternative, or your booking will automatically be cancelled and refunded in full.
5. Cancellations, Refunds & No-Shows
5.1 How to Cancel
All cancellations must be submitted through our platform unless the listing says otherwise.
5.2 Standard Refund Policy
• Cancel at least 24 hours before the service start time: Full refund
• Cancel less than 24 hours: No refund
• Changes requested less than 24 hours before: Not accepted
• Cut-off times are based on local Jamaica time
5.3 Weather / Force Majeure
In cases of weather, natural disasters strikes, government restrictions, or other force majeure, you, the Supplier or Connecting Jamaica may cancel or reschedule.
You are entitled to an alternative date or a full refund according to the listing.
5.4 Minimum Requirements Not Met
If a tour or service requires a minimum number of participants and that number isn’t met, a reschedule or full refund will be offered.
5.5 No-Shows / Late Arrivals
You must arrive at the meeting point at the time specified in the booking.
Failure to do so will be classified as a no-show, and no refund or rebooking will apply, even in cases of flight delays, medical emergencies, or other circumstances.
5.6 Refund Processing
Most approved refunds are processed within 48 hours.
The amount may take 5–7 business days to appear depending on your payment institution.
5.7 Supplier-Initiated Changes / Cancellations
Suppliers may modify or cancel a booking (date, inclusions, itinerary) if necessary.
If a change is material (e.g. time, route), and you are dissatisfied with the alternative offered, you may opt for a full refund.
5.8 Change / Cancellation Requests
You may request a change or cancel your booking up to 24 hours before the scheduled start time.
If the booking does not have a defined start time, cancellation must be requested no later than 11:59 PM two (2) days before the start date (local Jamaica time).
5.9 Supplier Acceptance
Requests for changes are not guaranteed.
They become effective only once confirmed by us (on behalf of the Supplier).
If the Supplier cannot accept, refund rights are governed by the original listing’s terms.
6. Provider Obligations & Customer Representations
6.1 Licensing & Safety
Providers must hold all required permits, licensing, insurance, and safety requirements and comply with Jamaican law and any applicable international standards.
6.2 Accurate Booking Info
You must provide full and accurate information when booking (e.g. passenger counts, ages, flight times, special requirements). If information changes, you must notify us promptly.
6.3 Health, Weight, & Age Requirements
Some services have specific requirements and may require age, weight, or additional details for safety or insurance reasons (e.g. helicopter rides, horseback riding, scuba diving).
You must comply with these or risk being denied participation without refund.
6.4 Travel Delays / Late Arrival Notification
For time-sensitive bookings (e.g. airport or cruise terminal transfers), you must notify us of arrival delays as soon as you know. Failure to do so may result in a no-show with no refund.
7. Assumption of Risk & Limitation of Liability
7.1 Assumption of Risk
Some activities are inherently risky.
You participate in services at your own risk, considering your physical and mental condition.
Physical or adventure-based activities carry inherent dangers.
7.2 No Liability for Service Content
We disclaim liability for any damage, injury, death, or loss resulting from acts or omissions of Suppliers, or from your use of a Product.
7.3 No Guarantees / Warranties
We do not provide warranties regarding Supplier performance, safety, legal compliance, availability, or quality of services.
7.4 Insurance
We strongly encourage you to procure and maintain adequate travel, liability, and health insurance covering the activities booked.
7.5 Limitation of Liability
To the extent permitted by law, our liability to you is limited (e.g. to the amount you paid for the applicable booking) and excludes consequential, incidental, or punitive damages.
8. Reviews, Content & User Conduct
8.1 Eligibility
Only persons who booked a service via our platform may submit a review.
8.2 Moderation and Removal
We may invite you to validate your review before publication.
Reviews may be removed if they breach policy, are promotional / incentivized, or violate content rules.
8.3 Non Modification
Once submitted, reviews cannot be edited by you (unless we permit).
To request removal, contact us.
8.4 License
You grant us a license to use submitted content (reviews, media, feedback) for platform and promotional purposes.
9. Data Privacy & Compliance
9.1 To ensure consistency, the following standard clauses from your overall Terms & Privacy are incorporated into these Booking Terms:
• User Conduct & Content standards (e.g. no infringing or illegal content)
• Intellectual Property & Licensing (your submission grants us rights to display, use, distribute)
• Data Protection & Privacy (processing of your personal data in line with the Privacy Policy)
• Dispute resolution, Governing Law, Assignment, Severability, Force Majeure
• Indemnification (you indemnify us for liabilities arising from your breach or conduct)
9.2 Your personal data is handled in line with our Privacy Policy, compliant with:
• Jamaican Data Protection Act
• GDPR (EU/UK)
• CCPA (California) where applicable
9.3 By booking, you consent to the use and sharing of your data with Providers for service delivery.
10. Disputes & Governing Law
10.1 These Booking Terms are governed primarily by Jamaican law.
However, for international customers, where applicable, provisions of UK/EU or US law concerning consumer protection, contract formation, or jurisdiction may supplement or override.
10.2 Disputes should first be addressed via our informal resolution process (customer support). If unresolved, disputes may be referred to arbitration (if agreed) or to competent courts (Jamaica or another applicable jurisdiction).
10.3 Invalid or unenforceable provisions may be severed without affecting the remainder.
11. Miscellaneous
11.1 Assignment
You may not assign or transfer your rights or obligations under these Booking Terms without our written consent. We may assign or delegate at our discretion.
11.2 Notices
Notices may be provided via email or via platform posting. They become effective when delivered or posted.
11.3 Entire Agreement
These Booking Terms, together with the General Terms & Conditions and Privacy Policy, constitute the entire agreement between the parties in relation to booking a service, superseding any prior agreements.
11.4 Survival
Clauses on liability, indemnity, intellectual property, and dispute resolution will survive termination or expiration of a booking or these Terms.
