Terms and Conditions for Connecting Jamaica

Please read these Terms & Conditions (“Terms”) carefully.
By accessing or using the Connecting Jamaica website (https://connectingjamaica.com), platform, mobile apps, or services (collectively, the “Services”), you agree to be bound by these Terms.
If you do not agree to all parts of these Terms, do not use the Services.
These Terms operate in conjunction with our Privacy Policy, which sets out how we collect, use, disclose, and manage your personal data.
1. Definitions & Interpretation
• “Platform / Website / Site” means Connecting Jamaica’s online platform, including web pages, apps, interfaces, and related services.
• “User / You” means any person accessing or using the Services (customers, vendors, service providers, partners).
• “Provider / Vendor / Supplier” means any individual or entity offering services (tours, transport, accommodation, experiences) via our platform.
• “Booking / Service Agreement” means the contract between a User and a Provider, arranged through our platform, for a service (tour, transfer, activity, accommodation, etc.).
• “User Content” means any content, information, text, images, reviews, ratings, photos, feedback, comments, listings, etc., that a user uploads, submits, or publishes via the platform.
• “Google Ads / Advertising Partners” means any third party ad networks or platforms (including Google) whose policies you may be subject to when advertising.
In these Terms, unless otherwise defined, words in the singular include the plural, and vice versa.
2. Acceptance & Changes
2.1 By using or accessing the Services, you accept and agree to be bound by these Terms, and any policy incorporated by reference (including our Privacy Policy).
2.2 We may revise or update these Terms from time to time (e.g. changes in law, business model). When we make material changes, we will notify users (e.g. via email or site banner). Continued use after changes constitutes acceptance.
2.3 You should review these Terms periodically to stay informed of updates.
3. Using the Services & Account Registration
3.1 You must be at least 16 years old (or the minimum age required in your jurisdiction) to use the Services or upload content. If you are registering on behalf of a business, you represent that you have authority to bind the business to these Terms.
3.2 To book or list services, you must provide accurate information, and maintain the accuracy of that information.
3.3 You are responsible for safeguarding your account credentials (username, password). You must not share your password or allow unauthorized use. You must notify us immediately of any breach or unauthorized use.
3.4 You guarantee that any User Content you upload is lawful, accurate, and does not infringe third party rights (copyright, privacy, trademarks, etc.).
3.5 You retain ownership of User Content you upload, but grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, translate, distribute, display, perform, and otherwise exploit that Content for the operation, promotion, and improvement of the Services and affiliated marketing (including via Google Ads, partners).
3.6 We may remove or disable access to any User Content that we believe, in our discretion, violates these Terms, is unlawful, or is otherwise objectionable. We are not obliged to retain copies of removed content.
4. Listings, Booking & Transactions
4.1 Our platform is a marketplace facilitator connecting Users (customers) with Providers. We are not a party to the Booking Agreement itself (except to the extent we offer direct services). The contract for the service is between the User and the Provider, subject to the terms set forth in the listing and these Terms.
4.2 You must read the details and terms of each listing carefully (service description, pricing, cancellation policy, schedule, inclusions/exclusions) before booking.
4.3 Pricing displayed on our Site (“Posted Price”) is what the Provider offers (including any commissions). The final booking price you pay (“Booking Price”) may include taxes, fees, conversions, or service charges.
4.4 Payment is processed via secure third party payment processors (e.g. Stripe, PayPal, etc.). By placing a booking, you authorize us (or authorized processors) to charge your selected payment method.
4.5 In some cases, a “Reserve Now, Pay Later” feature may apply (if offered). Terms (time of capture, cancellation windows) will be disclosed in the listing.
4.6 If a Provider cancels a booking, or fails to deliver, you may seek refund or remedy under the cancellation and refund policy for that listing.
4.7 You may request modifications (reschedules, changes in participant numbers) through our platform, subject to availability and Provider approval.
4.8 Disputes between Users and Providers should first be handled via our mediation mechanism (customer support). We may, at our discretion, suspend Providers or mediate refunds, but we do not guarantee outcomes.
5. Cancellation, Refunds & No shows
5.1 Cancellation and refund rules depend on each Provider’s policy as displayed on the listing. Some listings may be non-refundable or partially refundable within certain time windows.
5.2 To cancel or request a refund, you must use our platform (not direct communication with Provider) unless otherwise stated.
5.3 If a Provider fails to show, or cancels at short notice, you may qualify for full refund or alternative. We may facilitate refund decisions, but ultimate responsibility lies with the Provider (unless we explicitly operate as provider).
5.4 In cases of force majeure (weather, natural disaster, strikes, government restrictions), we or the Provider may cancel or reschedule. We will notify you as soon as possible. Refunds or alternatives may apply per listing policy.
5.5 Late arrival by you may be treated as a “no-show” and may forfeit your booking (no refund) depending on the policy.
6. Content & User Conduct
6.1 You agree not to:
• Use the Services for illegal, fraudulent, or harmful purposes
• Violate any local, national, or international laws
• Upload content that violates copyrights, is defamatory, obscene, offensive, discriminatory, or hateful
• Violate privacy or rights of third parties
• Upload viruses, malware, or harmful code
• Use bots, automated means, scraping tools, or reverse engineering
• Impersonate others or misrepresent affiliations
• “Spam” or post unwanted promotional content
• Interfere with security, network integrity, or operations
6.2 You are responsible for all User Content you upload.
You indemnify us against any claims (damages, liabilities, costs) arising from your User Content or conduct.
7. Intellectual Property & Licenses
7.1 All intellectual property rights in the platform (software, design, brand, logos, content) are owned or licensed by us or partners. No right is granted except as expressly provided.
7.2 By uploading User Content, you grant us (and our partners, sub-licensees) a license (as per Clause 3.5) for use, display, adaptation, distribution, marketing, embedding, caching, etc.
7.3 We reserve the right to edit or remove User Content, or refuse to post it, at our discretion, with or without explanation.
7.4 If any provision is invalid or unenforceable, that part may be severed without affecting the remainder.
8. Limitation of Liability & Disclaimers
8.1 Disclaimers
• The Services are provided “as is” and “as available,” without warranties of any kind (express or implied).
• We do not guarantee uninterrupted, error-free, or secure operation.
• We do not guarantee accuracy, completeness, or reliability of listings or content.
• We are not responsible for acts or omissions of Providers, including quality, safety, or compliance with local regulations.
8.2 Limitation of Liability
To the fullest extent permitted by law, we (and our affiliates, agents, employees) are not liable for indirect, consequential, incidental, punitive, or special damages (loss of profits, data, opportunity) arising from your use of the Services, even if we knew such damages may occur.
8.3 Exceptions & Minimum Liability
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud, or for any other liability that cannot legally be limited.
8.4 In jurisdictions requiring a monetary cap, our total liability is limited to the amount you paid in the prior 12 months (or a smaller statutory amount).
9. Indemnification
You agree to indemnify, defend, and hold harmless Connecting Jamaica and its personnel from any losses, liabilities, damages, costs, or expenses (including legal fees) arising from:
• Your breach of these Terms
• Your User Content
• Your violation of any laws or third party rights
• Your use of the Services
•
We reserve the right to control the defense and settlement of any claim.
10. Compliance with Advertising & Google Ads Policies
10.1 Providers listing services on our platform must comply with all applicable advertising policies, including Google Ads rules, local laws, and consumer protection standards (truth in advertising, disclaimers, cancellation terms, etc.).
10.2 We reserve the right to remove or refuse listings that violate Google Ads or platform standards (misleading claims, exaggerated descriptions, unfair pricing, hidden fees).
10.3 If we receive complaints, refund claims, or policy violations relating to a listing or advertisement, we may suspend or delist the offending Provider or content pending resolution.
11. Governing Law, Jurisdiction & Dispute Resolution
11.1 These Terms are governed by and construed in accordance with Jamaican law (or as your choice of governing law).
Where required or applicable, we also accept UK, EU, or US law (e.g. for cross-border disputes) under certain circumstances.
11.2 In the event of disputes, you and we agree to use informal negotiations first.
Failing resolution, disputes may be submitted to binding arbitration (if agreed) or resolved in courts with competent jurisdiction (e.g. in Jamaica, UK, US depending on your location and applicable law).
11.3 If a court finds a provision invalid or unenforceable, that part may be severed, and the remainder of the Terms will continue in full force.
12. Additional Provisions
12.1 Third-Party Links
Our Site may contain links to third-party websites or services.
We do not control and are not responsible for their content, practices, or policies.
12.2 Force Majeure
Neither party is liable for delays or failures caused by circumstances beyond their reasonable control (natural disasters, war, strikes, government restrictions, etc.).
12.3 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer in whole or part.
12.4 Notices
Any notice under these Terms may be given via email or posted on our platform.
Notices are effective when delivered (for email) or posted (for site notices).
12.5 Entire Agreement
These Terms (plus the Privacy Policy and any specific listing terms) constitute the entire agreement between you and us regarding the Services, superseding any prior agreements.
13. Provider / Vendor Specific Terms (If You List a Service)
If you wish to list a service on the platform, you must comply with additional rules:
• Hold all required permits, licenses, insurances, and regulatory approvals in your jurisdiction
• Provide accurate and non misleading descriptions, photos, pricing, terms, and cancellation policies
• Ensure safety, compliance and legal standards
• Cooperate in resolving User complaints, cancellations, refunds
• Accept that we may audit or review your listing, and remove non compliant listings
• Agree to commission, payment, and settlement terms as separately agreed
14. Miscellaneous
14.1 Severability — If any provision is held invalid or unenforceable, it will be severed, and the remaining terms will remain valid.
14.2 Waiver — A failure or delay by us to enforce any right is not a waiver of that right unless in writing.
14.3 Conflict — In case of conflict between a listing’s terms and these Terms, the listing’s specific terms prevail for that booking.
14.4 Survival — Provisions regarding liability, indemnity, intellectual property, and dispute resolution survive termination of your use.
